PinARt Privacy Policy

Dmitry Kourtchikov (“we”, “us”, “our”) operates the PinARt mobile application (“the App”). This Privacy Policy explains how we collect, use, and protect information when you use PinARt.

We are committed to protecting your privacy. PinARt is designed to process all data locally on your device. We do not operate servers, collect analytics, or transmit your personal data to any external service.

1. Data Controller

For the purposes of the EU General Data Protection Regulation (GDPR) and applicable data protection laws, the data controller is:

2. Data We Process

2.1 Camera Data

PinARt uses your device camera to render the augmented reality scene and detect wall surfaces via Apple ARKit. Camera frames are processed in real time on your device and are never recorded, stored, or transmitted unless you explicitly capture a photo or video using the in-app capture feature.

  • Legal basis (GDPR): Consent (you grant camera permission on first launch).
  • Retention: Camera frames exist only in device memory during the active AR session. They are discarded when you close the app.

2.2 Photos You Import

When you choose a photo from your Photo Library, Files, or a URL, the image is loaded into the AR scene on your device. If session recovery is enabled, a JPEG copy of placed photos is saved to your device’s local storage so the session can be restored after an interruption.

  • Legal basis (GDPR): Consent (you select the photo) and legitimate interest (session recovery).
  • Retention: Saved session data persists on your device until you start a new session or delete the app. We never access, upload, or transmit your photos.

2.3 Photos and Videos You Capture

When you take a photo or record a video of the AR scene, the capture is held in temporary memory until you choose to save it to your Photo Library or share it. If you dismiss the capture without saving, it is discarded.

  • Legal basis (GDPR): Consent (you initiate the capture and choose to save or share).
  • Retention: Saved captures are stored in your device’s Photo Library, managed by iOS. Unsaved captures are discarded immediately.

2.4 Microphone Audio

If you grant microphone permission, audio is recorded during video capture only. Audio is part of the video file and follows the same retention as captured videos (Section 2.3). The microphone is never accessed outside of active video recording.

  • Legal basis (GDPR): Consent (you grant microphone permission and initiate recording).

2.5 AR Spatial Data

Apple ARKit generates a 3D spatial map (ARWorldMap) of your surroundings to detect walls and surfaces. This data is processed entirely on your device by Apple’s ARKit framework. PinARt saves the ARWorldMap to local device storage to enable session recovery.

  • Legal basis (GDPR): Legitimate interest (core app functionality and session recovery).
  • Retention: The saved world map persists on your device until you start a new session or delete the app. It is never transmitted off your device.

2.6 App Preferences

PinARt stores your settings (measurement units, default dimensions, language preference, grid configuration, color presets) in the device’s local storage (UserDefaults). These preferences contain no personal information.

  • Legal basis (GDPR): Legitimate interest (remembering your preferences).
  • Retention: Preferences persist until you change them or delete the app.

2.7 Subscription and Purchase Data

PinARt offers optional subscriptions (PinARt Basic and PinARt Pro) through Apple’s App Store. All purchase transactions are processed by Apple via StoreKit. We do not collect, store, or have access to your payment information, Apple ID, or billing details.

The App verifies your subscription status locally on your device using Apple’s StoreKit 2 framework and Transaction.currentEntitlements. We store only your current subscription tier (Free, Basic, or Pro) in device memory to enable or disable features. This value is not transmitted anywhere.

  • Legal basis (GDPR): Performance of a contract (delivering the subscription you purchased).
  • Retention: Subscription status is determined at runtime from Apple’s transaction records on your device. We do not independently persist subscription data.

3. Data We Do NOT Collect

To be explicit, PinARt does not:

  • Collect or transmit personal data to any server
  • Use analytics, crash reporting, or telemetry frameworks
  • Track your location (ARKit spatial data is relative, not geolocated)
  • Use advertising identifiers or ad tracking
  • Use cookies or web tracking technologies
  • Create user accounts or require login
  • Access your contacts, calendar, health data, or any other device data beyond what is listed above
  • Share data with third parties (other than Apple for subscription processing)
  • Use your data for profiling, automated decision-making, or AI/ML training

4. Third-Party Services

4.1 Apple (App Store and StoreKit)

Subscription purchases are processed by Apple. Apple collects and processes purchase data according to their own privacy policy. We receive only a transaction verification result (product identifier and verification status) — we do not receive your Apple ID, payment method, or billing information.

4.2 No Other Third Parties

PinARt does not integrate any third-party SDKs, analytics services, advertising networks, or cloud services. All processing occurs on your device.

5. Data Transfers

PinARt does not transfer data outside your device. There are no servers, APIs, or cloud storage involved. Your data stays on your iPhone or iPad at all times.

For subscription purchases, Apple may transfer data internationally in accordance with their own privacy policy and applicable data transfer mechanisms.

6. Data Security

All data processed by PinARt resides in the app’s sandboxed storage on your device, protected by iOS security mechanisms including:

  • App sandbox isolation (other apps cannot access PinARt’s data)
  • Device encryption (data at rest is encrypted when your device is locked)
  • Secure Enclave protection for devices with biometric authentication

We do not implement additional encryption because we do not transmit data — iOS device-level protections apply to all locally stored data.

To delete all PinARt data: Delete the app from your device. This removes all locally stored session data, preferences, and color presets. Captured photos and videos in your Photo Library are not affected (manage those through the Photos app). To manage your subscription, go to iOS Settings > Apple Account > Subscriptions.

8. Your Rights Under GDPR

If you are in the European Economic Area (EEA), United Kingdom, or Switzerland, you have the following rights under the GDPR:

Access All your data is on your device. You can view preferences in Settings and photos in your Photo Library.
Rectification You can change any setting or replace any placed photo at any time.
Erasure Delete the app to erase all PinARt data. Start a new session to erase saved AR data.
Restriction You can revoke camera or photo permissions in iOS Settings at any time.
Portability Captured photos and videos are standard formats in your Photo Library, freely exportable.
Objection Since we do not process data for marketing, profiling, or legitimate interest beyond core functionality, this right is not typically applicable. You may contact us with any concerns.
Withdraw consent Revoke camera, photo, or microphone permissions at any time in iOS Settings > PinARt.

Since PinARt does not collect or transmit personal data to any server, most data subject requests are fulfilled by the user directly on their device. If you have questions or wish to exercise your rights, contact us at [email protected].

9. Your Rights Under Other Laws

California (CCPA/CPRA)

PinARt does not sell or share personal information. We do not collect personal information for commercial purposes beyond providing the App’s functionality. California residents have the right to know what data is collected (described in Section 2), to delete data (delete the app), and to non-discrimination for exercising their rights.

Brazil (LGPD)

PinARt processes data locally on your device based on consent and legitimate interest as described in Section 2. You may exercise your rights by contacting us at the email above.

Other Jurisdictions

If your jurisdiction provides additional privacy rights, we will honor them to the extent they apply. Contact us with any requests.

10. Children’s Privacy

PinARt does not knowingly collect personal information from children under 16 (or the applicable age in your jurisdiction). Since the App does not collect or transmit any personal data, it does not pose a risk to children’s privacy. Subscription purchases are subject to Apple’s parental controls and family sharing settings.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be reflected by the “Last Updated” date at the top of this document. The current version is always available within the App and at our website. We encourage you to review this policy periodically.

For material changes that affect how your data is processed, we will provide notice through an App update.
